Racing Tee Hub provides an online platform enabling users to design and sell their own T-shirts and merchandise. We strictly prohibit the creation or sale of items that infringe upon third-party intellectual property rights, including but not limited to copyrights, trademarks, and related rights. If you believe your intellectual property rights have been infringed by a Racing Tee Hub user, please follow the procedure outlined below to report the infringement.
A. Reporting Intellectual Property Infringement
Racing Tee Hub‘s policy is to:
Block or remove any content believed in good faith to infringe third-party intellectual property rights after receiving a compliant notice.
Terminate service to repeat infringers.
To report infringement, send a detailed notice containing the following information to our Designated Agent:
Identification of the copyrighted work or intellectual property allegedly infringed, including registration details if available.
Specific identification of the infringing content, including:
A description of how the content infringes your rights.
The exact location of the infringing content on the Racing Tee Hub platform.
Your full contact details: name, address, phone number, and email.
A good faith statement asserting that the use of the content is unauthorized.
A statement, under penalty of perjury, confirming the accuracy of your notice and your authority to act on behalf of the rights holder.
Your electronic or physical signature.
B. Post-Infringement Notification Procedure
Upon receiving a bona fide infringement notice, Racing Tee Hub will:
Remove or disable access to the identified content.
Notify the user whose content has been removed.
Terminate repeat infringers’ access to the Service.
C. Submitting a Counter-Notice
If you believe the removed content was wrongly taken down, you may submit a counter-notice to our Designated Agent containing:
Identification of the removed or disabled content, including its original location on the Service.
A statement, under penalty of perjury, asserting that the content was mistakenly removed or misidentified.
Your contact details: name, address, phone number, and email.
A consent statement to the jurisdiction of the Federal Court relevant to your address or, if outside the USA, the jurisdiction where Racing Tee Hub is located. You must also agree to accept service of process from the original complainant.
Your electronic or physical signature.
Upon receiving a counter-notice, Racing Tee Hub may inform the original complainant that the content may be reinstated after 10 business days unless legal action is initiated. Content may be restored within 10 to 14 business days, at Racing Tee Hub‘s discretion.
Important Notice: Under Section 512(f) of the DMCA, any false claims regarding infringement may result in liability for damages, including legal fees.
